A Bangor-area doctor who had his license revoked for allegedly sexually assaulting a patient is now facing criminal charges.
Michael J. Gilmore, a now-former doctor, operated Maine Functional Medicine in Bangor until he signed a consent agreement Aug. 8 in which he admitted there was a “preponderance” of evidence for the allegation that he sexually assaulted a then-23-year-old woman during an appointment.
Gilmore, 60, of Brewer, is charged with one felony count of unlawful sexual contact and one misdemeanor count of unlawful sexual touching, according to a complaint in Penobscot County Superior Court.
He was arrested Sept. 1 after Bangor police obtained a warrant. He was granted a $2,000 bail that same day. His initial court appearance is scheduled for Dec. 11.
Gilmore’s lawyer did not immediately respond to requests for comment.
The criminal charges follow two appointments with the woman, one in January and one in March. The Bangor Daily News does not typically name victims of alleged sexual assault without their permission.
During an examination on March 11, Gilmore allegedly touched the woman’s vaginal area and nipples without medical reason, according to an account from Bangor police in the court records. Gilmore told police the actions he took were for medical reasons.
The woman submitted a complaint April 25 to the Maine Board of Osteopathic Licensure. The board held a hearing July 11 and had a second scheduled for late August until Gilmore signed the consent agreement.
During the appointment, Gilmore said the woman brought up her lack of libido and other conversations around her sex life. The woman testified to the board she did not initiate the conversation and didn’t know what a libido was until Gilmore explained it in the conversation.
Maine Functional Medicine closed this fall after Gilmore’s license was permanently suspended.
